Zoning protects the rights of property owners while promoting the general welfare of the community. By dividing land into categories according to use and setting regulations for these categories, a zoning ordinance can govern private land use and segregate incompatible uses. The purpose of zoning is to locate particular land uses where they are most appropriate, considering public utilities, road access, and the established development pattern. Details such as building setback lines, the height of buildings, the amount of impervious area, the size and location of open spaces, and the intensity to which the land may be developed are also determined by our HAA professionals.
Rezoning is a useful planning tool for land development and neighborhoods. Rezoning allow property owners to determine uses which are different than the uses permitted by the current zoning. As communities change, the appropriate use of an individual property may also change. Rezoning is useful in instances where the land uses around a property have changed, or where residents of an area desire a less intensive use in their neighborhood.
When a property owner wants to use land in a way that is not permitted by the current zoning of their property, the owner must request to rezone the property to a classification which permits the desired use. A rezoning is a legislative action which is considered through a complex process. HAA professionals are experienced with the rezoning process and will work with the land owner to create a development plan that can successfully navigate the rezoning process.
